| 21.27 La Crosse River - University of Wisconsin - La Crosse
Whereas, the University of Wisconsin - La Crosse proposes to fill a certain portion of the La Crosse Marsh adjacent to the La Crosse River; and
Whereas, the Wisconsin Department of Natural Resources is of the opinion that such fill is improper without the establishment of a bulkhead line.
The City of La Crosse, La Crosse County, Wisconsin, by and through its Common Council, does hereby declare that the interest of the public requires the establishment of a bulkhead line as hereinafter described.
The bulkhead line is established and determined as set forth in the following description and the attached map, to-wit:
A bulkhead line located in the NE 1/4 of Section 32, Township 16 North, Range 7 West, City of La Crosse, La Crosse County, Wisconsin, described as follows: Commencing at the East 1/4 corner of said Section 32, a stone monument; thence N01o47'30"W along the East line of said Section 32, a distance of 1,460.48 feet to a 1 1/2 inch iron pipe in the north line of Gorder Road and the point of beginning of a bulkhead line described as follows: Thence S89o52'00"W along said North line 1,496.00 feet to a 1 1/2 inch iron pipe; thence S01o47'30"E460.05 feet to a 1 1/2 inch iron pipe; thence N89o52'00"E 380.00 feet to a l 1/2 inch iron pipe and the point of termination of said bulkhead line. The bulkhead line is declared to be in the public interest because it permits acceptable fill development of the University of Wisconsin - La Crosse north campus. The adoption of this ordinance shall not be construed to preclude the City of La Crosse, Wisconsin, any citizen or land owner thereof, from challenging the validity or legal significance of an ordinary high water mark in the La Crosse River Marsh in any proceeding. The only effect of this ordinance shall be to allow the University of Wisconsin-La Crosse to place structures or fill in a certain area of the La Crosse River Marsh and should not preclude the City of La Crosse, any citizen or land owner from future lawful development of the La Crosse River Marsh. The mean high water line or the ordinary high water mark as delineated by the Wisconsin Department of Natural Resources on the annexed map shall not be of precedential value in connection with future development in the La Crosse River Marsh and this ordinance shall not be considered as an admission by the City of La Crosse that any ordinary high water mark is conceded or established. This ordinance shall not prevent the City of La Crosse, any citizen or land owner from requesting the right to from time to time to reestablish bulkhead lines waterward from the bulkhead line described herein. The City of La Crosse is of the opinion that said ordinary high water mark as delineated on the attached map does not represent the existing shoreline or ordinary high water mark for the La Crosse River and said delineation shall be of no effect for other requests for permits from the federal or state government in connection with flood laws, water laws, floodplain laws, etc. That upon adoption of this ordinance, the City Clerk shall file with the Department of Natural Resources for its approval three copies of the map together with three copies of this ordinance establishing the bulkhead line. Upon approval by the Department of Natural Resources, the City Clerk shall file the copies of the map and the ordinance as follows: One in the office of the Department of Natural Resources, one in the office of the City Clerk and one in the office of the Register of Deeds for La Crosse County.
