Wisconsin law (2023 Wis. Act 73) made significant changes to municipal licensing and regulation of cigarette, tobacco, and vapor products, effective March 6, 2024, including:
- Requiring retailers that sell electronic vaping devices to obtain a retail license from their municipality.
- Creating minimum standards for persons to hold a municipally-issued retail license.
- Requiring municipalities to use a retail license application forms created by the Wisconsin Department of Revenue (DOR) - new forms are linked below.
License Period
Licenses to sell cigarettes, tobacco, and electronic vaping devices are issued for one year periods, expiring on June 30th.
License Fee
A non-refundable license fee of $100.00 is due at the time of application (cash, check payable to City Treasurer or credit with convenience fee).
How to Apply
Applications shall be made in writing on the forms prescribed by law and filed with the City Clerk's Office. The application must identify what products are being sold and whether they are sold over the counter or by vending machine or both. The applications must be completed in full and signed. Licenses are issued within fifteen (15) business days of application.
Forms:
- Application for business (CV-100) - any individual or entity wanting to sell cigarettes, tobacco products or electronic vaping devices to consumers.
- Individual Questionnaire (CV-101) - completed by each person involved in the applicant business (sole proprietor, partners, members of LLC or officers of corporations).
- Appointment of Agent (CV-102) - completed by the appointed agent of a corporation or LLC. *Wisconsin law requires corporations and limited liability companies (LLCs) to appoint an agent that takes responsibility for the licensed premise.
